Independence Day: Have Fun, Stay Safe and Avoid Charges
Fireworks go hand in hand with the 4th of July, but each year thousands of people, most often kids and teens are injured. Most people don’t realize or acknowledge the inherent danger. For instance, sparklers burn at 1200 degrees Fahrenheit! Further, most local jurisdictions present impressive shows and displays designed and fired off by professionals. They’re typically easy to find and can be enjoyed without risk of injuries.
With a professional fireworks show, there is also no risk of violating the law. That’s not necessarily the case with people who set off their own fireworks. While fireworks sold in other states are definitely more exciting to watch, they are not legal in Virginia. In fact, many people are unaware of the difference between legal and illegal fireworks in the Commonwealth. Remember, in Virginia, it is illegal to possess, use, store, sell, or handle any firework that explodes, rises into the air or travels laterally, or to fire projectiles into the air. ... However, fireworks that stay on the ground, like pinwheels, fountains and sparklers, are legal through the state code.
It goes without saying that everyone wants to avoid celebrations which end with a criminal charge, so please be responsible while enjoying them this year. In the unfortunate event you are charged with a crime for any reason over the holiday weekend, remember it’s important to have an experienced criminal defense attorney help you deal with it. Tom and I have been practicing criminal defense law in the Commonwealth since the early ‘90s, and are here, and glad to help you if you get into any trouble.
